Any information sent in the contact forms on the website will become part of the IT systems of TEXTIL TEXTURA, S.L., which complies with the safety measures required to guarantee the confidentiality, integrity, security and recoverability of the information. This information will be used to respond to your request for information or enquiry, to supply you with the products purchased, to provide you with the corresponding post-sale service, and to inform you of our news and promotions as a member of our Club.

4. Profiling and Automated Individual Decision-making

We inform you that automated individual decision-making will be done by means of profiling. The Premium Club is a loyalty programme based on understanding our customers, and it is necessary to establish variables to help us with segmentation. We wish you a happy birthday, reward you for seniority and communicate with you according to the type of product you prefer, therefore, the value that PREMIUM brings to the Textura customer is based on analysing your data.

For Premium Club members we calculate a score based on frequency and average purchase value, product category and channel used. This profiling is used to send out discounts and personalised recommendations.

You have the right to request human intervention, express your views or object to this automated individual decision-making by writing to rgpd@textura-interiors.com.

If you do not wish to receive our personalised communications and perks, you can shop as a Guest Customer.

5. Recipients and Processors

Your data will not be disclosed or transferred, except when requested legally by a public body. We share your data with suppliers who provide maintenance services for the IT systems and the company hired to host the website and email, whose servers are located in the European Union.

Under no circumstances will data be transferred internationally.

You can request a full updated list at any time.

6. International Transfers

Data is only transferred to providers located outside the European Economic Area when a proper safeguarding instrument is in place, Standard Contractual Clauses supplemented by additional measures are used to ensure the protection of your data.

7. Storage Periods

Your data will be kept for the period of time provided by law for the purchase of products and their invoicing, in the event that you purchase our products. If you belong to the Premium Club, your data will be kept indefinitely as long as you do not unsubscribe, and your consent may be revoked at any time.

You may withdraw your consent to receive communications at any time by using the link that accompanies each email to let us know you want to UNSUBSCRIBE, or by sending an email to rgpd@textura-interiors.com. From then on, you will no longer receive any communication from us.

TEXTURA is a retail web portal offering home textiles and decorative accessories through its online platform.

Acceptance of the General Terms and Conditions
To use TEXTURA’s services and purchase its items, you must read and accept our General Terms and Conditions, as well as our Legal Notice and Privacy Policy. Any request for services implies the automatic acceptance of these Terms and Conditions.

These Terms and Conditions are subject to the provisions of Royal Legislative Decree 1/2007 of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (TRLGDCYU), Law 7/1996 of January 15 on Retail Trade Regulation, Law 7/1998 of April 13 on General Contract Conditions, and Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (LSSI-CE). Law 3/2014 of March 27, which amended the TRLGDCYU to transpose Directive 2011/83/EU on consumer rights, shall also apply.

TEXTURA may amend the Terms and Conditions, with prior notice to clients, to improve the services offered through our website. TEXTURA reserves the right to modify or discontinue, at its discretion, all or part of the services offered. This shall not entitle users to any compensation. In any case, the applicable Terms and Conditions are those in force at the time the order is confirmed and paid.

If any clause in these Terms and Conditions is declared null or unenforceable, in whole or in part, such nullity or unenforceability will only affect that provision or the part thereof affected. The rest of the Terms and Conditions shall remain valid.

Website Registration
To use TEXTURA’s services or purchase its items, you may choose to register or shop as a guest.

If you choose to shop as a guest, you will only need to provide the information necessary to complete the purchase. Your data will be used to process the purchase, manage any necessary after-sales service, and carry out related administrative tasks. This information will be retained for the legally established periods.

If you choose to register as a Premium customer, in addition to managing your order, you will receive the company’s newsletter via email, containing news, promotions, and other information of potential interest.

Registering as a user on www.textura-interiors.com is free of charge. Registration is revocable, and you may cancel your registration at any time by contacting hola@textura-interiors.com. Once your registration is cancelled, you will no longer receive any communications or promotions from TEXTURA.

Anonymous registrations or registrations using false email addresses are not allowed. By registering, the user declares they are of legal age (18 years or older) and have the legal capacity to enter into a contract and use the services offered by TEXTURA.

The user accepts full responsibility for the use of the security code sent to their email address during access. TEXTURA assumes no responsibility for the use of such codes by other individuals authorized by the user, nor for damages resulting from unauthorized use. The client must immediately report any improper use of their account.

Purchase Process and Contract Formalization
The contract is formalized at the moment the order is validated by clicking the “Pay Now” button.

When selecting one or more products, a summary page titled “Your Bag” will be displayed, showing a photo of each item, a description, color, reference, selected quantity, unit price, and the total order amount. It is essential that you verify this information to ensure it accurately reflects your selection before confirming your order. At this stage, you may remove items, change quantities, or continue shopping.

Once the items are confirmed, you must click the “Continue to Payment” button. You will then be prompted to select a delivery method, delivery address, payment method, and, where applicable, bank details. After completing the payment, the order will be sent to TEXTURA for processing and preparation.

TEXTURA guarantees that the product images are as accurate as possible in terms of color, design, and measurements. Any discrepancy may be due to reasons beyond our control. However, if the issue is due to our own error or inaccuracy, you will have the right to cancel the purchase in accordance with our Return Policy set out in section 12 of these Terms.

If you have any questions about product characteristics, you may contact our Customer Service Department at 931 740 007, Monday to Thursday from 10:00 to 14:00 and from 16:30 to 20:30, or Friday and Saturday from 10:00 to 14:00, excluding national, regional, or local holidays.

Once the purchase and payment are made, the client may not cancel or modify the order, as we prepare the purchase immediately upon receipt.

Product Availability
Although products listed as available on the website are usually in stock (unless otherwise indicated), it may happen that the last units are purchased while the customer is finalizing their order. In such cases, when we receive the order, one or more items may no longer be available. Therefore, all product orders are subject to availability.

If some items are temporarily unavailable, we will wait to restock the complete order before shipping it. If the arrival of these products causes a significant delay, we will contact you to discuss whether you prefer a partial shipment within the stated delivery time, or to wait for the full order, in which case a new delivery date will be set. If you no longer wish to receive the unavailable item(s) due to the delay, you may cancel that part of the order and receive a full refund for those items.

In some exceptional cases, a product may be permanently out of stock, even after the order confirmation has been sent. If this occurs, we will contact you again to arrange a full refund for the unavailable item(s).

TEXTURA reserves the right to withdraw any product from the website at any time and/or to remove or modify any of its content.

Prices
The sale prices of the products offered are those indicated on the website, in the pricing section of each product description.

Prices are shown in euros (€).

All online prices are displayed with VAT included.

The prices listed at any given time on the website will apply to orders placed at that precise moment. However, TEXTURA may modify its prices at any time. Any changes will be communicated in advance through the website and will only apply to orders placed after the change has been published.

For customized orders, since it is not possible to calculate the cost of potential variations the buyer may request (such as specific measurements, materials, or other details), the final price will be shown only after the client has completed all necessary specifications. At that point, the final price will be displayed before order confirmation.

Once the order is placed, full payment must be made, including product costs, applicable taxes, and shipping fees.

In all cases, TEXTURA will confirm receipt of the order and its details (including payment method) via an automatic email confirming the purchase. This email will confirm that the order has been sent to the indicated address or to the selected TEXTURA store for pickup. It will also include a payment confirmation and a detailed summary of the purchased products.

Shipping Costs
Shipping costs are not included in the item price and are calculated based on the total price of the items and the destination.

For home delivery within mainland Spain and the Balearic Islands, the shipping cost is €5.90.

Orders over €49 (VAT included) and all orders—regardless of amount—chosen for pickup at a TEXTURA store will enjoy free shipping.

Orders under €49 (VAT included) with pickup at a collection point will have a shipping cost of €3.90.

Shipments to the Canary Islands, Ceuta, and Melilla are subject to an additional charge, customs clearance procedures, and special taxes. Shipments to the Canary Islands include outbound shipping and the corresponding export DUA. Please note that on delivery, you will also need to pay the import DUA and the IGIC (7% of the invoice value). These and any other customs-related charges are the responsibility of the buyer.

For orders outside Spain, the buyer may contact us at 931 740 007. Our customer service hours are Monday to Thursday from 10:00 to 14:00 and 16:30 to 20:30, and Friday to Saturday from 10:00 to 14:00, excluding national, regional, or local holidays.

Shipments to non-EU countries may incur additional taxes and fees, which are the buyer’s responsibility. TEXTURA will handle the necessary paperwork and documentation for customs clearance.

Under no circumstances will TEXTURA cover any costs or fees charged at the destination upon receipt of the order—whether taxes, duties, or customs expenses. TEXTURA only charges for shipping to the destination address.

If the customer refuses to pay the customs fees at destination (including for the Canary Islands), the shipment will be considered abandoned. TEXTURA assumes no responsibility in such cases and will not refund either the order amount or the shipping costs.

Payment Methods
The accepted payment methods for purchasing items from TEXTURA are:

- Debit and credit cards: Visa, Mastercard, American Express

- PayPal

- Bizum

- Sequra

Credit card payments are subject to verification and authorization by your card issuer. If your payment is not authorized, TEXTURA will not be responsible for any delay or failure to deliver the order, and no contract will be finalized.

If you choose to pay via PayPal, you must authorize the transaction using your PayPal username and password.

Delivery Times
Delivery times are calculated in business days from the confirmation and payment of the order, as follows:

Spain (Mainland only): 2 to 4 business days

Balearic Islands: up to 6 business days

Canary Islands, Ceuta, and Melilla: please consult

Europe and the rest of the world: please consult

TEXTURA is not responsible for delays caused by exceptional circumstances. Delivery times may also be extended during promotional or sales periods.

If the new delivery date exceeds the originally indicated date by more than 7 days, and the delay is attributable to TEXTURA (e.g., due to lack of stock or internal issues), the buyer may cancel the order and receive a full refund of the amount paid.

Delivery and Receipt
Orders will be delivered by a transport or courier company to the delivery address provided by the buyer during the ordering process.

If the recipient is not available, the courier will contact them via SMS or phone to arrange a new delivery date. If a second delivery attempt also fails, the order will be returned to the courier’s depot. A third delivery attempt will incur an additional charge to be paid by the recipient.

The buyer must check the condition of the packaging and the contents of the order in the presence of the courier at the time of delivery.

If there is any discrepancy or issue with the packaging or the condition of the products, the nature of the issue (e.g., open package, damaged goods) must be noted on the delivery slip and signed. The buyer must then immediately contact the Customer Service Department at 931 740 007 (Monday to Thursday from 10:00 to 14:00 and 16:30 to 20:30, or Friday and Saturday from 10:00 to 14:00, excluding holidays) or by email at hola@textura-interiors.com to report the problem.

If you did not receive the order in person and were therefore unable to check its condition at the time of delivery, you must still contact Customer Service using the same contact details above.

For the purposes of these Terms and Conditions, delivery shall be considered complete when:

Home delivery: upon signing for the package with the courier.

Store pickup: upon signing the delivery slip at the selected TEXTURA store.

You must notify Customer Service as soon as possible in cases of non-receipt or delivery delays exceeding 5 business days (for mainland Spain) or 7 business days (for the Balearic Islands).

Once delivery has taken place, TEXTURA is no longer responsible for any risks related to the products.

Right of Withdrawal and Returns
You may withdraw from your online purchase within 30 days of receiving the order, for any reason and without the need to justify your decision.

All products purchased on the website may be returned at your own risk within 30 days of the date on which the products came into your physical possession (or that of a third party other than the carrier, as designated by you), as you are entitled to a right of withdrawal under applicable law.

If you return your order within this period, we will refund the full product price paid. However, shipping costs will not be refunded and are your responsibility. The refund will be issued without undue delay and no later than 15 days from the date on which you notify us of your decision to return the products. The refund will be made via the same payment method used for the purchase. We may withhold the refund until we have received the returned products or until you provide proof of having sent them back, whichever occurs first.

The only requirement for refund eligibility is that the items must be unused and undamaged, in order to avoid any depreciation.

Custom-made or personalized items are excluded from the right of withdrawal, as they have been manufactured specifically according to the customer's specifications.

Returns must be requested via the website. The customer is responsible for shipping the return, but TEXTURA will bear the cost of return shipping. Indicating a reason for the return is not mandatory, although it is requested in the return form for statistical purposes and to help improve the shopping experience. As stated in the Return Policy section of our Shipping and Returns information page (https://www.textura-interiors.com/envios-y-devoluciones), a return document will be included in your order package. If lost, you may request a new one through TEXTURA’s customer service channels. It is not essential to present the document in order to exercise your right of withdrawal.

In cases where the return is due to reasons beyond the customer’s control, TEXTURA will cover all shipping and handling costs related to the return or exchange. If the delivered products have obvious manufacturing or material defects, including those caused during transportation, or if the products do not match the order, please contact Customer Service immediately at 931 740 007 or email hola@textura-interiors.com.

TEXTURA will cover return shipping costs in the following situations:

The products received do not match the order.

In cases of hidden defects that could not reasonably be detected within the first 14 days, TEXTURA will evaluate the claim on a case-by-case basis and only offer a refund if the issue is determined to be inherent to the product and not caused by improper use by the customer.

To ensure faster processing, do not combine returns from multiple orders into a single package.

For orders collected at a TEXTURA store, the return or withdrawal can be processed directly in-store. If the return is intended for an exchange, the customer may make the exchange at the store as long as the new item is of equal or higher value (no refund will be processed in that case). Refunds for returned items will be issued using the same payment method as the original purchase.

Cash refunds will not be issued under any circumstances.

Legal Warranty of Conformity
All products sold by TEXTURA, being consumer goods, are covered by the legal warranty of conformity established in Royal Legislative Decree 1/2007 of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws (TRLGDCYU).

Duration: The legal warranty period is three (3) years for new products from the date of delivery. For products purchased before January 1, 2022, the warranty period was two (2) years.

Lack of conformity: Products are considered to conform if they match the description provided by TEXTURA, are suitable for their intended use, and exhibit the usual quality and performance expected of similar products.

Presumption of lack of conformity: Unless proven otherwise, any lack of conformity that becomes apparent within two years of delivery will be presumed to have already existed at the time of delivery.

In the event of a lack of conformity, the consumer is entitled to repair or replacement of the product, a price reduction, or contract termination. TEXTURA is responsible for any lack of conformity present at the time of delivery.

Repair or replacement will be free of charge for the consumer, including shipping costs, labor, and materials. These actions will be carried out within a reasonable time and without significant inconvenience to the consumer.

A price reduction or contract termination may occur if the consumer cannot request repair or replacement, or if these remedies are not provided within a reasonable time or cause significant inconvenience. If TEXTURA does not repair or replace the product correctly, the consumer is also entitled to a refund or termination.

To exercise the warranty, the customer must contact TEXTURA via hola@textura-interiors.com or the customer service phone line and provide the invoice or purchase receipt.

Disclaimer of Warranties and Liability
